Цим листом ми хотіли б інформувати Вас про поточну ситуацію та процеси в Україні щодо встановлення належного управління Українським Національним Доменом Верхнього Рівня .UA: Стосовно адміністрування домену ".UA" ми вважаємо за необхідне інформувати Вас про наступне.

With this letter we would like to inform you about the current situation and processes in Ukraine aimed to establish proper governance of Ukrainian National Top Level Domain .UA: Concerning the administration of the ".UA" domain we find it necessary to inform you as follows.

На думку Української Інтернет Асоціації (ІнАУ), членами якої є приблизно 50 першокласних українських інтернет-сервіс-провайдерів, існуюча система для адміністрування домену ".UA" сприяє задовільному виконанню основних технічних процедур, але потребує поетапної та послідовної реформи.

In the opinion of the Ukrainian Internet Association (UIA), the members of which include approximately 50 first-class Ukrainian Internet service providers, the existing system for administration of the ".UA" domain currently facilitates the carrying out of basic technical procedures satisfactorily, but requires successive and gradual reform.

Українська Інтернет Асоціація (ІнАУ) приймала участь в розвитку головних ідей для створення Українського мережевого інформаційного центру (UANIC), який повинен не тільки задовольнити вимоги абсолютної більшості учасників ринку Інтернет в Україні, але також повинен прийняти до уваги зацікавленість уряду, та (в цілому) відповідатиме міжнародній практиці.

The Ukrainian Internet Association (UIA) participated in the development of the basic ideas for establishment of the Ukrainian Network Information Center (UANIC) which would have not only met the requirements of the absolute majority of Internet market participants in Ukraine, but would also have taken into account governmental concerns, and would have been in line with international practice.

Однак, фундаментальні організаційні принципи для розвитку Українського Мережевого Інформаційного Центру (UANIC), які початково були визначені за допомогою ІнАУ, були сильно порушені в минулому році під час реалізації цього проекту. Сьогодні Служба Безпеки України та представники державного монополіста "Укртелеком" отримали абсолютний контроль над UANIC на шкоду переважної більшості ІСП та іншої публіки (громадськості) і зацікавлених державних структур. Спроби двох інших державних організацій - Міністерства Економіки і Державного Комітету Підприємництва - прийняти участь (у складі) UANIC були проігноровані. Цей факт примусив ІнАУ відмовитись від участі в цьому проекті.

However, the fundamental organizational principles for developing the Ukrainian Network Information Center (UANIC), which were originally determined with the aid of the UIA, have been severely violated in the past year during implementation of this project. Today the Security Service of Ukraine and representatives of state telecommunication monopolist Ukrtelecom have gained absolute control over UANIC to the detriment of the vast majority of ISPs, and other public and state structures concerned. The efforts of two other state organizations, the Ministry of the Economics and the State Committee for Entrepreneurship, to take part in the UANIC were also disregarded. This fact forced the UIA to renounce its participation in this project.

Таким чином, ми звертаючись до ICANN з цим запитом, (просимо) взяти до уваги думку ІнАУ, та в цей час утриматись від здійснення змін до системи адміністрування доменних назв в Україні, як таких, що сильно порушують інтереси членів ІнАУ та інтереси всього Інтернет-співтовариства в Україні.

Hence, we are addressing ICANN with this request to take into account the opinion of the UIA, and for the time being to refrain from making changes to the domain names administration system in Ukraine, as such changes would severely infringe upon the interests of UIA members and the interests of the whole Internet community in Ukraine.

Brief Information About Ukrainian Internet Association

Українська Інтернет Асоціація (ІнАУ, http://www.inau.org.ua) заснована в листопаді 2000 року та є добровільною асоціацією юридичних осіб, бізнес яких пов'язаний з діяльністю на ринку послуг Інтернет. Члени ІнАУ, що налічують приблизно 50 компаній (див. прикладений перелік членів) - Інтернет-сервіс-провайдерів, розробників контентних проектів, власників порталів, постачальників обладнання, і також із засобів масової інформації. ІнАУ сприяє розвитку Українського ринку Інтернет, координації співробітництво між членами, публікує, розробляє та здійснює проекти, спрямовані на покращення функціонування Інтернет сервісів.

The Ukrainian Internet Association (UIA, http://www.inau.org.ua) was founded in November 2000 and is a public voluntary association of legal entities, the businesses of which are connected with the operation of the Internet services market. Members of the UIA, numbering about 50 companies (see the List of Members enclosed), are Internet service providers, content project designers, owners of portals, equipment suppliers, and also from the mass media. The UIA facilitates development of the Ukrainian Internet market, coordinates cooperation between members, and publicizes, designs, and implements projects aimed at improving the functioning of Internet services.

Для виконання її цілей, ІнАУ в червні 2001 року створила філіал, називаний Українська мережа обміну трафіком (http:://www.ua-ix.net.ua), яка має більш ніж 50 учасників, включаючи багато (учасників) з різних регіонів України. Компанія допомагає їм зменшити їх витрати та розширює їх можливості бізнесу. "Українська мережа обміну трафіком" - запорука стабільності для Українського ринку Інтернет.

In order to put its aim into practice, the UIA established a subsidiary called the Ukrainian Traffic Exchange Network (http://www.ua-ix.net.ua) in June 2001, which has more than 50 participants including many from the various regions of Ukraine. The company assists them in minimizing their expenses and in widening their business opportunities. The Ukrainian Traffic Exchange Network is the pledge of stability for Ukraine's Internet market.

ІнАУ має різні технологічний, юридичний та бюджетний комітети. Їх функціями є розробка пропозиції до Парламенту України (Верховної Ради) для законодавчих актів, та для розвитку проектів, які будуть реалізовуватись ІнАУ.

The UIA has various technological, legal, and budget committees. Their functions are to generate proposals for legislative acts to the Parliament of Ukraine (Verkhovna Rada), and to develop projects to be implemented by the UIA.

В 2001 році ІнАУ створила Арбітражний Суд. У відповідності до вимог ICANN, тільки Арбітражні Суди повинні вирішувати спори з доменних питань. Арбітражний Суд ІнАУ унікальний. Це діє на території України у відповідності до власних статутів та зроблено так, що має власних арбітрів.

In the year 2001 the UIA established the Arbitration Court. In accordance with ICANN requirements only the Arbitration Court can settle disputes on domain issues. The Arbitration Court of the UIA is unique. It acts on the territory of Ukraine under its own statutes and has it own arbiters.
